Abuse Of Process Definition
The tort of beginning or otherwise using the judicial civil or criminal process for an improper purpose. There may be a legitimate basis for instituting or using the judicial process, but the actual intent behind the action is improper. See also malicious prosecution.
A cause of action in tort arising from one party making a malicious and deliberate misuse or perversion of regularly issued court process (civil or criminal) not justified by the underlying legal action.
